Afghan Children's Right to Education in Iran in Light of International Law (Dari)

Abstract

Right to education - as one of the fundamental rights, which forms the ground for every human understanding - serves as a means to the achievement of other intellectual rights such as freedom of expression, freedom of speech and freedom of religion. This explains why the right to education enjoys such a high-ranking position among other human rights. Free, compulsory prima- ry education and freedom of education are three important elements of the right of child education. Afghan children in Iran may be categorized in three dif- ferent groups: refugee children, lawful migrants, and unlawful migrants. This article seeks to evaluate Iran's practice and compliance to aforementioned obligation about Afghan children in its territory from an international law perspective. Findings of this article show, which group of Afghan children in Iran have access to free education. In this regard, Iran's compliance and its interna- tional obligations in past history will also be taken into consideration.
