| Abstract: | Death, resignation, impeachment, dismissal, and illness are the conditions to replace President of Afghanistan. The President personally tenders his resignation to the National Assembly, and his resignation shall not require the approval of another authority or entity. Impeachment of the President shall demand the acknowledging his accusation of committing crimes against humanity, national treason or crimes approved by two-thirds of Wolesi Jirga (House of People) and majority of two-thirds of Loya Jirga (House of Elders). In the case of conviction of the President in a special court, the impeachment will be decisive and the president shall be dismissed. Realization of the incurable illness of the President shall be verified by an authoritative medical team assigned by the Supreme Court. The duties and authorities of the President will be transferred to his First Vice-President and, in the case of absence of the First Vice-President, the Second Vice-President shall act in accordance with the provisions of the constitution. In the event of simultaneous death of President and his First Vice-President, the Second Vice-President, the President of the Meshrano Jirga, the President of the Wolesi Jirga and the Foreign Minister shall respectively assume the duties of the President. The maximum period of presidential substitution, except in the case of realization of an interim impeachment, shall be three months. The First Vice-President as interim president shall not amend the constitution, dismiss the ministers and call for a referendum. |
